Amendments to the Habitats Regulations 1994 for England and Wales came into force on the 21st August 2007 – revising the definition of “deliberate disturbance” of European Protected Species as well as Removing the “incidental result defence” – Which means there is now no defence in killing, injuring or capturing a European Protected Species or damaging or destroying a breeding site, roost or resting place, whether intentionally or due to accident.
